<p><P>PROBLEM TO BE SOLVED: To prevent useless retransmission by paying attention to a relation of a retransmission request to actually performed transmission and appropriately controlling time-out period in retransmission control by a TCP. <P>SOLUTION: In data packet transmission and reception by a transmitter Tn and a receiver Rn through a communication network NW, when there is retransmission by fast retransmit, the transmitter Tn then adjusts a time-out period of an unacknowledged data packet each time a duplicate ACK packet is received.
