A hierarchical encoding device and a method thereof are provided to enable a ground wave DMB receiver to restore hierarchical video and audio signals selectively according to the performance of the ground wave DMB receiver while providing a video screen having more superior resolution and multi channel audio. A hierarchical video encoding unit(31) inputs a video signal to perform hierarchical video encoding by a MPEG-4 SVC(Scalable Video Coding) encoding method. And the hierarchic video encoding unit generates a hierarchical video ES(Elementary Stream). A hierarchic video encoding unit(32) inputs an audio signal. And the hierarchical audio encoding unit performs hierarchic audio encoding by the MPEG-4 audio encoding method. And the hierarchical audio encoding unit generates a hierarchical audio elementary stream.
