METHOD FOR UPGRADING SOFTWARE AND BROADCAST RECEIVING APPARATUS USING THE SAME

A method for controlling software upgrade and a broadcast receiving apparatus thereof are provided to check whether software upgrade of a mounted card is possible before upgrade and perform the upgrade, thereby upgrading the software of the card without error even though the number of cards mounted in a broadcast receiving apparatus increases. If a DTV(Digital TV) becomes in a standby state(S505), a controller in the DTV transmits an "open_homing" message to a cable card through a cable card interface(S510). The cable card transmits an "open_homing_reply" message to the controller through a cable card interface in response to the "open_homing" message(S515). And then, the controller transmits a "homing active message to the cable card through the cable card interface(S520). The controller and the cable card start homing through the steps of S505 and S520. And then, the cable card transmits a "firmware_upgrade" message to a controller through a cable card interface. And then, the controller a "fireware_cardtype" message to a headend through an OOB(Out-Of-Band) receiving unit(S530).
