PROBLEM TO BE SOLVED: To perform encoding processing with satisfactory image quality even if an error occurs in a bit stream, while information indicating that the error occurs in the bit stream is produced.

SOLUTION: A decoding apparatus 10 includes a means 12 for producing image data by decoding a bit stream, a means 12 for producing encoding parameters for each hierarchy, and a means 12 for producing an error flag that indicates whether the encoding parameters can be used effectively or not. An encoding apparatus 30 includes a means 41 for judging whether the encoding parameters can be used effectively or not based on the error flag, a means 36 for calculating encoding parameters when the encoding parameters are not effective, and means 38, 39 for performing encoding of the image data using the encoding parameters from the decoding apparatus 10 when the encoding parameters are effective, and performing encoding of the image data using the calculated encoding parameters when the encoding parameters from the decoding apparatus are not effective.
