PROBLEM TO BE SOLVED: To provide a magnetic sensor unit with dispersion in the size of a gap made smaller than ever between a magnetic sensor and a magnetic pattern; and a magnetic rotary encoder. SOLUTION: The moving amount of a sensor cover to the substrate side is regulated since the sensor cover 122 is provided with a spacer part 122b having a height enough to prevent the sensor cover from moving to the sensor substrate 111 side. Accordingly, a size-variable gap is prevented from appearing between the sensor substrate and the sensor cover when performing position adjustment on the magnetic sensor unit 120 relative to the magnetic pattern 131 by using a spacer tool 140, for example, and therefore, dispersion in the size 145 of the gap can be made smaller between the sensor unit and the magnetic pattern.
