PROBLEM TO BE SOLVED: To provide a recording and reproducing device for reproducing a received program without skipping a CM part and reproducing the program without interrupting a main program. SOLUTION: A recording and reproducing device comprises: a recording position detection means 14 for detecting a recording start position of a main program to be recorded by being split to a recording medium and a recording start position of the CM part; a reproduction control data generation means 16 for generating reproduction control information so as to control an order of reproduction by which only the main program divided into many parts is continuously reproduced after selecting and reproducing the CM part; and a reproducing means 121 for reproducing which is controlled by the reproduction control information and reproduces programs without skipping the CM parts out of the programs recorded to the recording medium.
