PROBLEM TO BE SOLVED: To provide a thermostat expansion valve having over-flow function or safety function while controlling high pressure in a refrigerating circuit or a heat pump circuit which is operable on a transcritical and subcritical basis, to be in an optimum range. SOLUTION: The thermostat expansion valve comprises a valve element 33 attached to a first operating element 36 including a chamber 38 storing a control charge 41. Herein, an operating element 46 is provided to be thermally activated independently of high pressure. The temperature-dependent operating motion of the operating element 46 is joined to a first operation face 37 of the first operating element 36 in relation to the motion when going against the operating motion of the first operation face 37 of the first operating element 36, and a temperature threshold value for the thermally activative element 46 for operating motion is set to be the same value as MOT (the maximum operating temperature) of the control charge 41 of the first operating element 36.
