A trellis encoder and a trellis encoding device having the same are provided to prevent an additional reference signal from being distorted by resetting a memory of the trellis encoder when transmitting a transmission stream into which the additional reference signal is inserted. A trellis encoding device having a trellis encoder includes a plurality of trellis encoders(320-1-320-12) and a parity compensation unit(400). The trellis encoders perform trellis encoding for a transmission stream into which an additional reference signal is inserted, and perform separately a memory reset in a previous section of the additional reference signal processing. The parity compensation unit compensates a parity of the transmission stream in response to a value stored in the memory of the trellis encoders. The trellis encoders have at least one trellis encoder of first to fifth type trellis encoders.
