PROBLEM TO BE SOLVED: To provide an overflow pipe which is increased in draining performance and can positively prevent rainwater from infiltrating into a room, and to provide an overflow draining structure. SOLUTION: The overflow pipe 30 is arranged in a wall (rise wall 6) of a balcony 3, for draining water overflowing a drainage drain pipe 4. According to the overflow draining structure, the overflow pipe 30 formed of a drain pipe 31 having a rectangular cross section extending longer in a the horizontal direction, and a flange portion 32 arranged on an upstream-side edge 31a of the drain pipe 31, is installed in a wall surface of the balcony 3 such that the upstream-side edge 31a of the drain pipe 31 is located lower than a lower edge of a sash 8 opening in the balcony 3.
