A method and an apparatus for transmitting the data of an RLC layer by a timer in a mobile communication system are provided to enable a transmitting RLC layer to perform polling trigger before disusing the RLC SDU(Service Data Unit) of a transmission buffer to check the receiving state of a receiving RLC layer, and enable the receiving RLC layer to perform a retransmission process for an RLC PDU(Packet Data Unit) when the transmission of the not-received RLC PDU belonging to the RLC SDU is not completed, thereby preventing the failure of data transmission caused by the disuse of the RLC SDU. A method for transmitting the data of an RLC(Radio Link Control) layer by a timer in a mobile communication system comprises the following steps of: storing a data packet transmitted from an upper layer for transmission and starting a first timer(610); requesting a receiving party to report the state of the received data packet when it is determined that the data packet is not normally transmitted in the termination of the first terminal, and starting a second timer(620); and disusing the stored data packet in the termination of the second timer.
