PROBLEM TO BE SOLVED: To obtain an optical element in which a Fresnel (surface) reflection on a lens surface causing flare and ghost is reduced and to obtain a scanning optical system having the optical element. SOLUTION: The optical element is provided with a fine structural grating on at least one optical face, and the fine structural grating comprises structure having an anti-reflection function in accordance with the incident angle of a luminous flux.
