PROBLEM TO BE SOLVED: To provide a communication system and its device in which probability of communication failure caused by busy call is decreased, enabling a document to rapidly arrive at a transmission end. SOLUTION: When transmitting image data to a given destination using a public telephone line, the communication device makes inquires, to the destination, about whether being presently busy in transmission with other communication device on a network. When a response from the other communication device indicates that the other communication device is presently transmitting to the destination, the communication device interrupts the transmission to the destination and after a given time has elapsed, re-inquiry is made to the other communication device. Then, when the response from the other communication device indicating that the destination is presently not busy in transmission to the destination has arrived, the communication device transmits to the destination.
