PROBLEM TO BE SOLVED: To provide a fixing device which restrains excessive temperature rise in a paper non-passing area at a nip part by existent temperature control without requiring complicated temperature control, and maintains the improvement of fixing property and the shortening of warming-up time in spite of inexpensive and simple constitution, and also to provide an image forming apparatus. SOLUTION: The fixing device is equipped with a heating roller 22 and a pressure roller 23 rotating in a press-contacting state each other, and is provided with a heat radiation member 33 constituted of an aggregate of two kinds of thermal deformation members 34 and 35 having a different thermal expansion coefficient so as to come into contact with the outer periphery of the heating roller, and also arranged in the paper non-passing area W in the nip width of the nip part 21 formed by the heating roller 22 and the pressure roller 23. The heat radiation member 33 is deformed so that contact area with the outer periphery of the heating roller 22 may be changed in accordance with the temperature of the paper non-passing area W due to a difference between the thermal expansion coefficients of the two kinds of thermal deformation members 34 and 35.
