PROBLEM TO BE SOLVED: To provide an upper body capable of efficiently suppressing the tilting of a cab when the load from a lateral direction is applied, and also to provide a construction machine equipped with the same. SOLUTION: The upper body is provided with a base frame 2 arranged on a lower traveling body, a pair of vertical boards 6, 7 erected on the base frame 2, a boom 3 having a base end pivoted on the vertical boards 6, 7 inside the vertical boards 6, 7 and capable of being raised and tilted relative to the base frame 2, the cab 4 erected on the base frame 2 to sandwich the vertical board 7 between the boom 3 and itself and a contact member 5 arranged on the boom 3 in such a way that the boom 3 takes an attitude with a maximum working radius and the contact member 5 comes into contact with the side face of the cab 4 earlier than the vertical plate 7 at a position above the upper end part of the vertical board 7 when the cab 4 receives external force from a lateral direction toward the boom 3.
