An apparatus and a method for processing moving picture packets are provided to resolve the congestion of a network efficiently by discarding packets in consideration of priority among the moving picture packets. A packet-determining unit(210) determines that the type of a packet missed among moving picture packets is a packet of an intra picture, a packet of a predicted picture, or a packet of a bidirectional picture. A packet-discarding unit(220) discards some of packets having the same GOP(Group Of Picture) ID as the missed moving picture packet, based on the determined result.
