An encoding and decoding apparatus and a method thereof are provided to encode signals, which have different kinds of characteristics from each other, such as a voice signal or an audio signal at a optimal bit rate. An apparatus for encoding and decoding signals comprises a bit unpacking part, a residual signal generating part, a signal mixing part, a difference signal decoding part(120), a mixing part, and first an second encoding parts(100,110). The difference signal decoding part decodes the encoded difference signals having information on the difference between the mixed signals and the original signals. The first and second encoding parts encode the inputted signals and the difference signals by using the audio decoding method executed on the time domain.
