PROBLEM TO BE SOLVED: To provide a state estimating device for person and state estimating method for person, estimating the state of person with high accuracy. SOLUTION: This state estimating device 1 for person, which estimates the state of a subject, includes: first index value obtaining means 3, 4, 7 for obtaining a first index value corresponding to a state change amount of the subject; a gain setting means 7 for setting a gain for determining temper of the first index value in estimating the state of the subject; and a state estimating means 7 for regulating the temper of the first index value depending on the gain, and estimating the state of the subject based on the first index value of temper depending on the gain and the past state of the subject.
