PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor excellent in surface mechanical durability and oxidation resistance, suppressing an image defect caused by deposition of a discharge product, while having excellent sensitivity and low friction against sliding and high water repellency, and easily maintaining these characteristics at a high level with time. SOLUTION: The electrophotographic photoreceptor comprises a conductive substrate, a photosensitive layer and a surface layer, having the photosensitive layer and the surface layer stacked in this order on the conductive substrate, wherein the surface layer contains a group 13 element and nitrogen and/or oxygen, and the photoreceptor has an intermediate layer between the surface layer and the photosensitive layer.
