A linear motor and a machine tool having the same are provided to prevent a magnet member from falling down when power is cut off and avoid excessive load during operation by a fall preventing device. A linear motor(1) includes a magnet member(2), a coil member(3), and a magnetic substance(13). The magnet member is composed of a permanent magnet with N and S poles alternately arranged in an axial direction. The coil member is arranged to be orthogonal to the axial direction with respect to the magnet member. The magnetic substance is arranged to be adjacent to one end of the coil member to operate magnetic attraction of the magnet member. The axial direction is a vertical direction. The magnet member is a moving member, and the coil member is a fixed member. The magnetic substance is arranged to be adjacent to an upper end of the coil member to prevent a fall of the magnet member.
