A signal receiving device in a mobile communication system using an MIMO(Multiple Input Multiple Output) scheme and a method are provided to use a 2-stage ML(Maximum Likelihood) scheme as using a hybrid scheme for an ML scheme according to channel states when an FDFR(Full Diversity Full Rate) scheme is used in the MIMO mobile communication system, thereby minimizing operational complexity as maintaining reception performance. A selector(220) detects a selection parameter for selecting a signal detection scheme to be employed by a signal receiving device among plural signal detection schemes by using a channel matrix, compares the selection parameter with a threshold value, and selects one signal detection scheme of the plural signal detection schemes according to the compared results. A signal detector(240) detects a transmission signal in accordance with the signal detection scheme.
