PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor capable of forming a high quality color image and maintaining smoothness of the photoreceptor surface in an electrophotographic photoreceptor extremely excellent in wear resistance. SOLUTION: The surface layer of the electrophotographic photoreceptor comprises a crosslinked resin prepared by curing at least, trimethylol propane triacrylate, a charge transporting substance having a thermosetting or radical polymerizable functional group, a silicone compound having a radical polymerizable functional group, a fluorine-based surfactant having a radical polymerizable functional group, and a silicone compound rejecting component having a radical polymerizable functional group with a wettability of 55 mN/m to less than 65 mN/m with the above silicone compound.
