PROBLEM TO BE SOLVED: To provide a heat fixing device that improves the responsiveness with respect to overheating of a fixing member and surely shuts off the supply of power to a heating means, and to provide an image forming apparatus that has the heat fixing device. SOLUTION: A heat roller 42, to which a pressure roller 44 is pressed, is supported rotatably by a bearing member 51, made of a material which softens, when it exceeds the heat fixing temperature. A thermostat 48, in which a bimetal 67 is exposed in the direction of the heat roller 42, is disposed opposite to the pressure roller 44 with respect to the heat roller 42. A heat conductive member 71 is interposed in between the heat roller 42 and the bimetal 67. As a result, supply of power to a fixing heater 47 by the thermal deformation of the bimetal 67 can be shut off; as well as, the heat roller 42 is moved due to the softening of the bearing member 51, the bimetal 67 is deformed mechanically by depression of the heat conductive member 71, and supplying of power to the fixing heater 47 can be shut off.
