PROBLEM TO BE SOLVED: To record a content ciphered by a CSS (content scramble system) ciphering system in an optical recording medium for recording in a reproducible state. SOLUTION: When discrimination information, indicating that only the contents ciphered by a CSS ciphering system is a recordable content, is stored in an optical disk, contents is recorded in a data region of the optical disk, and key information is recorded in a lead-in region of the optical disk (S405, S409). Meanwhile, when discrimination information is not stored and meandering of a track of the optical disk has no meandering part that deviates from the DVD+R standards, the optical disk is ejected (S423).
