PROBLEM TO BE SOLVED: To provide a fixing device that makes temperature unevenness of a heat roller in an axial direction uniform over the entire area and obtains an image of high image quality while saving energy at a low cost regardless of a paper size, and to provide an image forming apparatus having this fixing device. SOLUTION: The fixing device includes: a fixing roller 1 having a heat-resistant elastic layer 12; a pressurizing member 2 disposed in pressurized contact with the fixing roller 1; and a separating member 3 disposed downstream of a first nip formed by the fixing roller 1 and pressurizing member 2, forming a second nip while being pressurized contact with the fixing roller 1, and for separating paper from the fixing roller 1 by deforming the heat-resistant elastic layer 12.
