An apparatus and a method for estimating a time offset in a MIMO(Multiple Input Multiple Output) communication system using an OFDM(Orthogonal Frequency-Division Multiplexing) or OFDMA(Orthogonal Frequency-Division Multiple Access) are provided to calculate an estimated value of a time offset for compensating for a phase of a pilot and data by using a preamble and a pilot of a DL(DownLink) PUSC(Partial Usage of Subchannels) mode. An apparatus for estimating a time offset in a MIMO communication system using an OFDM(Orthogonal Frequency-Division Multiplexing) or OFDMA(Orthogonal Frequency-Division Multiple Access) includes a preamble linear phase calculation unit(330), a pilot linear phase calculation unit(340), and a time offset calculation unit(350). The preamble linear phase calculation unit calculates a preamble linear phase based on a preamble included in a received signal frame of a plurality of receiving antennas. The pilot linear phase calculation unit receives signals transmitted from a plurality of transmission antennas using a different pilot pattern through the receiving antennas, and calculates a pilot linear phase based on the pilot pattern of the transmission antennas. The time offset calculation unit calculates a time offset based on the calculated preamble linear phase and the pilot linear phase.
