A very safe handheld laser processing device is provided to detect the relative position of a workpiece with a simple structure, and a laser processing method using the device is provided. A laser processing device comprises: a light transmitting part for transmitting a laser light(6); and a light emitting unit for receiving the laser light from the light transmitting part and projecting the laser light to a workpiece(20) to process the workpiece, wherein the light emitting unit includes: a torch body(100); a workpiece detecting probe provided at an end of the torch body; a condensing lens(2) for collecting the laser light onto a focus positioned apart from the end of the torch body; a first circuit which provides the probe with power, and calculates the distance using input signals varied based on the distance between the probe and the workpiece; a second circuit for detecting a contact between the probe and the workpiece based on signals from the probe; and a control unit(8) for controlling the generation of the laser light according to the contact between the probe and the workpiece and the distance between the probe and the workpiece.
