PROBLEM TO BE SOLVED: To improve an image quality by appropriately executing de-blocking process.

SOLUTION: A deblocking filter 113 adjusts a value of disable_deblocking_filter_idc, slice_alpha_c0_offset_div2 or slice_beta_offset_div2 on the basis of activity of an image calculated by an activity calculating section 141, a sum of orthogonal transformation coefficients for an image calculated by an orthogonal transform section 142, complexity of an image calculated by a rate control section 119 or a sum of prediction errors of an image calculated by a prediction error summation section 120. The invention is applicable to encoding devices.
