PROBLEM TO BE SOLVED: To provide an optical device which is a sub wavelength birefringent optical device and allows to change the phase difference between polarizing components crossing each other at a right angle in the plane of the optical device. SOLUTION: The optical device controls the phase difference due to polarization direction of incident light in a scale equal to or below wavelength by utilizing structural birefringent effect locally caused by nearly periodical rugged structure, wherein the height or depth of the rugged structure is not uniform in surface of the optical element.
