PROBLEM TO BE SOLVED: To provide a nonaqueous electrolyte composition and a nonaqueous electrolyte battery capable of suppressing swelling under high temperature environment. SOLUTION: The nonaqueous electrolyte composition contains a carboxylic acid having hydrogen capable of getting dissociated as a proton and is used for the nonaqueous electrolyte battery. The carboxylic acid has a multiple bond and/or a halogen. The multiple bond of the carboxylic acid adjoins a carboxyl group and is conjugated. The nonaqueous electrolyte composition furthermore contains a polymer compound such as a polyvinyl formal, a polyacrylic asid ester, and polyvinilidene-fluoride. The nonaqueous electrolyte battery is equipped with a positive electrode, a negative electrode, the nonaqueous electrolyte composition, a separator, and an outer packaging member for housing them, and the nonaqueous electrolyte composition contains the carboxylic acid having hydrogen capable of getting dissociated as the proton.
