A communication device improving the throughput of the whole communication system while making contention dispersion control to make transmission chances equitable by observing the medium occupancy state. The communication device comprises a backoff processing section for performing normal backoff processing simultaneously with transmission of a transmission frame and pseudo-backoff processing of performing pseudo-backoff when no transmission frame is transmitted by using a contention window, a medium information acquiring section for acquiring medium information representing the state of the transmission channel medium when no transmission frame is transmitted by the pseudo-backoff processing, and a medium state judging section for deriving judgment information by judging the state of the transmission channel medium by using the medium information.
