A DRM(Digital Rights Management) system and a controlling method thereof are provided to increase convenience/satisfaction in contents use and promote contents purchase by facilitating appreciation among a plurality of users while restricting illegal contents distribution. A user device(20) stores contents, and transmits information of the contents to be transferred and at least one information of a receiver according to user selection. A server registers transferred contents information and receiver information received from the user device, converts the contents uploaded from the user device into streaming data, and transfers streaming data to more than one receiver. The server includes a license server(10) checking a contents transfer right by checking a license of a user requesting contents transfer, and a streaming server(12) converting the contents uploaded from the user device into the streaming data and transferring the streaming data to more than one receiver when a contents transfer request of the user is legal.
