A portable terminal and a method for taking a picture by using pupil codes are provided to overcome the inconvenience of a user for deleting a stored unnecessary image taken by an existing camera. A portable terminal includes a camera part(104), a pupil code part(112), and a photographing part(114). The camera part(104) includes at least one camera. The pupil code part(112) detects the maximum aperture ratio of a pupil of a model and a present aperture ratio of the pupil of the model in response to a photographing command. The photographing part(114) compares the maximum aperture ratio with the present aperture ratio and controls the camera part(104) to photograph the model. The photographing part(114) controls the camera part to photograph the model if the maximum aperture ratio is identical to the present aperture ratio.
