An LCD and a fabrication method are provided to remove the cause on light leakage by a backlight by forming an organic insulating layer of a high aperture ratio structure using a resin black matrix, developing the resin black matrix and patterning a transparent electrode matrix as an overlap structure. A gate line(102) and a data line(113) are formed to intersect each other on an array substrate. A thin film transistor is formed at an intersection of the gate lines and the data lines. A black matrix(115) is formed on the thin film transistor and the data line. A pixel electrode(117) is formed on the black matrix and is connected to the thin film transistor. An upper substrate is coupled with the array substrate at a predetermined gap and includes a color filter, and a liquid crystal layer is formed between the upper substrate and the array substrate. The pixel electrode partially overlaps the data line. |
