A policy and charging control method when the user is roaming, includes that: the policy and charging execution function of the visited network PCEF receives the request of setting up service bearer from the user equipment UE, and requests the policy and charging control rules to the policy and charging rules function PCRF of the visited network (101); the PCRF of the visited network requests the information needed for constituting the policy and charging control rules to the first PCRF of the UE home network determined by the visited network, and receives the information needed for constituting the policy and charging control rules which isreturned by the first PCRF (102); the visited PCRF constitutes the policy and charging control rules of the visited network according to the returned information and sends the policy and charging control rules to the visited network PCEF (103).
