A method, an equipment and a communication network for negotiating the mobile IP capability include: the mobile IP capability is negotiated by the authentication, authorization process and/or the capability negotiation process of the layer beyond physical; and the service information finally provided by the communication network is obtained. By using the invention, the communication network could determine whether to provide the capability of the MIP and the corresponding service.
