A light emitting element and a light emitting device are provided to reduce a loss of light extraction efficiency caused by a reflection by forming an insulating layer for changing continuously a refractive index. An insulating layer(102) comprising silicon, oxygen and nitrogen is formed on a first electrode layer(101). An electroluminescent layer(103) comprising an inorganic compound is formed on the insulating layer. A second electrode layer(104) is formed on the electroluminescent layer. Where a concentration of oxygen contained in the insulating layer is decreased from the first electrode layer side toward the electroluminescent layer side, and a concentration of nitrogen contained in the insulating layer is increased from the first electrode layer toward the electroluminescent layer.
