An apparatus and a method for constructing and executing functions of an application suitable for a broadcasting receiving device are provided to enable the broadcasting receiving device on a network to provide its information when the application is received and executed so that the application can select whether to activate or inactivate a function of the plural function elements. An application generating unit(310) generates one application having at least two or more functions which will be selectively performed by a broadcasting receiving device and generates information about the application. An application transmitting unit(320) transmits the generated application and information about the application to the broadcasting receiving device by using a predetermined communication mode. The application determines a function which will be activated among the two or more functions by using information about the broadcasting receiving device, and provides the determination result to the broadcasting receiving device.
