A method for performing DRM and tracking by using a characteristic of virus and a system for performing the method are provided to grasp a degree of the distribution and use of digital contents on the basis of DRM information and perform DRM and tracking for the digital contents by generating the DRM information related to the digital contents from a DRM code and transmitting the DRM information to a DRM system. A method for performing DRM(Digital Right Management) and tracking comprises the following steps of: allowing a DRM system(201) to insert a DRM code with a characteristic of virus to digital contents; and performing DRM and tracking for the digital contents on the basis of DRM information generated by the DRM code. The DRM code is inserted into another program and performs a DRM function by using the virus features of performing a function quietly when the digital contents are reproduced.
