PROBLEM TO BE SOLVED: To provide a newly-composed surface light emitting laser dispensing with the arrangement of a low-refractive-index medium onto the substrate-side interface of a photonic crystal layer. SOLUTION: A multilayer film mirror 1300, an active layer 1200, and a refractive index period structure layer 1020 of which a refractive index changes periodically are laminated in a direction vertical to the inplane direction of a substrate 1500. A resonance mode is achieved in a waveguide composed of the refractive index period structure layer and the multilayer film mirror. When light having a wavelengthλis allowed to go into the refractive index period structure layer vertically, the light is divided into at least transmission light and diffraction light capable of entering the multilayer mirror in the refractive index period structure layer.
