PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor that prevents defects of the output picture qualities of an image forming apparatus such as wear or scratches due to repeated use of the photoreceptor, hardly causes image density unevenness and can form an image of high picture quality for a long period of time, by increasing oxidizing gas resistance without decreasing mechanical durability of a photoreceptor when a crosslinkable material is used to improve the wear resistance and scratch resistance of the photoreceptor surface layer. SOLUTION: The electrophotographic photoreceptor has a photosensitive layer and a surface layer formed in order on a conductive support, wherein the surface layer is formed by curing a radical polymerizable monomer having no specified charge transport structure and a radical polymerizable compound having a charge transport structure by using heat, light or ionizing radiation, and the photosensitive layer and/or the surface layer contains an amine compound having a specified structure.
