PROBLEM TO BE SOLVED: To provide a torque control device of an internal combustion engine capable of restraining a driver from bodily sensing an unreachable feeling of acceleration, by improving a continuance of output torque in a process of transferring to a release from restriction of the output torque of the internal combustion engine. SOLUTION: This torque control device compares request torque Tdem calculated in response to an acceleration request from the driver with restriction torque Tgrd set in response to restriction of exhaust emission, and sets smaller torque as target torque Ttrg so as to restrict the output torque of the internal combustion engine 1 by the restriction torque Tgrd or release its restriction, and controls the output torque so that the internal combustion engine 1 is operated by the target torque Ttrg. Annealing processing to the target torque Ttrg is performed in an annealing degreeβin a process of transferring to a released state from a state of restricting the output torque.
