PROBLEM TO BE SOLVED: To enable a user to access to a network, even if a use of communication resources reaches an over-congested level, due to the efficient use of the communication resources in a communication system under overloaded condition. SOLUTION: This method and device in the communication system for data communication comprises detecting a demand for opening a connection for the user for the data communication, selecting an open connection, releasing the selected open connection, and allocating to the user communication resources corresponding to a resource released, based on the release of the selected open connection.
