PROBLEM TO BE SOLVED: To provide a vertical resonator type surface-emitting laser having a reflecting mirror capable of achieving a high reflection factor and transverse mode control simultaneously, and to provide a manufacturing method of a two-dimensional photonic crystal in the laser. SOLUTION: In the vertical resonator type surface-emitting laser having an active layer 104 between first and second reflecting mirrors, at least one of the first and second reflecting mirrors includes a two-dimensional photonic crystal 107. The reflecting mirror containing the two-dimensional photonic crystal has a structure 106 having nonuniform, effective refractive index distribution in the surface of the reflecting mirror, thus controlling the traverse mode.
