METHOD AND SYSTEM FOR DATA TRANSMITTING IN A COMMUNICATION SYSTEM

A data transmission system in a communication system and a method thereof are provided to optimally use resources and maximize the throughput by adaptively using band AMC(Adaptive Modulation and Coding) and diversity at the same time. A mobile station receives MAP information from a base station and confirms it(601). At this moment, the mobile station confirms its own present state and judges whether it is using band AMC or diversity. In case it is judged that band AMC is being used(603), the mobile station transmits packets using its own MAP information(603,605). If it is judged that diversity is being used(607), however, the mobile station grasps information about unused bands(609). Then the mobile station confirms the number of unused bands through the grasped information or a band AMC information MAP and grasps a diversity pattern to be used, based on the confirmed number(611). Then the mobile station transmits packets according to the diversity pattern using its own MAP information(613).
