An optical disc device and a method for discriminating a focused layer of an optical disc are provided to discriminate a focused recording layer at the time when an optical beam is focused on the recording layer by judging position relation between the focused recording layer on which the optical beam is focused and a non-focused recording layer on which the optical beam is not focused on the basis of output signals of the first light receiving unit and the second light receiving unit and discriminating the focused recording layer on the basis of the judged result. An objective lens(23) condenses an optical beam on a recording layer of an optical disc. A condensing lens condenses a reflective optical beam reflected from the recording layer. The first PD(Photo Diode)(26A) and the second PD(26B) are installed in a position distant by equivalent distance before and after a focus of the reflective optical beam condensed by the condensing lens. A microcomputer judges position relation between a focused recording layer on which the optical beam is focused and a non-focused recording layer on which the optical beam is not focused in a two-layer optical disc on the basis of output signals of the first and the second PDs(26A,26B), and discriminates the focused recording layer on the basis of the judged result.
