PROBLEM TO BE SOLVED: To prevent a pressing mark of a housing from being left on a stack of paper sheets and to keep the printing quality. SOLUTION: In this stapler, a staple 111 formed U-shaped is pushed into the stack of paper sheets 200 to bind it. The stapler includes: a pusher 120 for pushing the staple 111; the housing 130 for holding the pusher to push the staple, wherein a cushion member 140 abutting on the top face of the stack 200 of paper sheets is provided outside of staple projecting parts and the space between them on the paper stack side surface in the housing 130.
