PROBLEM TO BE SOLVED: To discriminate accurately optical disks classified into two kinds even when such situation is caused that amplitude of tracking error signals of optical disks of two kinds to be discriminated are approximated values. SOLUTION: The device is provided with a reading position moving means 21 moving a reading position of an optical pickup 2 to a first position and a second position being different each other in the radial direction by driving an actuator 11 for tracking, and a value detecting means 22 detecting a balance value of the tracking error signals, the disk discriminating means 23 discriminates a kind of the optical disk based on variation quantity of the balance value when the reading position is moved from the first position to the second position.
