PROBLEM TO BE SOLVED: To provide a diffractive optical element capable of improving characteristics such as diffraction efficiency, and to provide the convenient manufacturing method of the diffractive optical element. SOLUTION: The diffractive optical element contains a light-transmissive layer comprising a DLC film (1) and the light-transmissive layer contains a plurality of high refractive index regions 1b and low refractive index regions 1a which are periodically and alternately arranged in directions parallel to the layer surface so as to operate as a refractive index modulation type diffraction grating, wherein the surface of each of the high refractive index regions 1b has a projecting shape 1d operating as a relief type diffraction grating.
