A downlink voice packet network packet scheduling device in a mobile communication base station system and a method thereof are provided to measure delay time when delay is started if the transmission delay of VoIP(Voice over Internet Protocol) packets occurs, and to previously set packet loss in a suitable ratio, thereby reducing the transmission delay of the VoIP packets. When packets of a voice packet network are received, network transmission delay time is calculated by using a difference of time stamp values in case of base station arrival time and generation of the packets(301-305). If the packets refer to packets to be currently scheduled, queuing delay time is calculated by using a difference between base station departure time and the base station arrival time of the packets(307-313). Packet transmission delay time is calculated by using a sum of the queuing delay time and the calculated network transmission delay time(315). It is checked whether the calculated packet transmission delay time satisfies a predetermined threshold value, and if so, transmission of the packets is determined, and if not, dropping of the packets is determined(317-323,325).
