PROBLEM TO BE SOLVED: To provide a transmitting device capable of transmitting delivery conformation reliably by selecting the transmission/reception path of the delivery conformation of an electronic mail appropriately according the environment between devices, and to provide a receiver, a method of controlling the transmitting device and the receiver, a communication system, and a program. SOLUTION: The transmitting device transmits electronic mails to the receiver via a network by selecting one of the communication method via a mail server and that without using the mail server. The transmitting device generates electronic mails, and transmits the electronic mail and information for indicating the answering method of a delivery confirmation request to the electronic mail to the receiver.
